Layer Manager ( Bug ? )

I set up a simple scene, with some trees and a player for some testing. I use the layer manager to simulate depth ( player in font / or behind a tree... ). i want to make it darker over time with a black actor over it.

I am using the extended version with GUI from Forge so that i can put actors in front of everything.

i have a semi transparent actor in front of everything ( see screenshot ). but when i turn the layer manager on it makes semitransparent to nontransparent.

I tried changing the transparency with set opacity and fade to xxx% over time but it does not work.

i attached a screenshot. on the left is the editor, you can see the black thing has transparency, but in flash its not transparent at all.
